You may use this site for lawful purposes only. You may not scrape, copy, redistribute, or republish its content without written permission. All images, text, and designs are protected by copyright.

3. Commissions

Commissioning a work is a two-stage process:

1. Inquiry & Blueprint — you share your vision, we provide a written proposal, mockups, and quote.
2. Formal Agreement — production begins only after a signed agreement and deposit are received.

Production timelines (typically 4–9 weeks including drying and shipping) are estimates and may vary based on complexity and destination.

4. Pricing & Payment

Prices are quoted in Canadian Dollars (CAD) unless otherwise stated. A 50% deposit is required to begin work; the balance is due before shipment. Payment methods are specified on each invoice.

5. Cancellations & Refunds

Once painting has begun, the deposit becomes non-refundable because the work is unique and cannot be resold. If you cancel before production starts, we refund the deposit minus any costs already incurred (mockups, materials).

6. Shipping & Risk

Artworks are shipped with tracking and insurance. Risk of loss passes to the buyer upon delivery to the carrier, but we will assist in any insurance claim. Customs duties and local taxes are the buyer's responsibility.

Copyright of commissioned artworks remains with Heyda Inc. unless expressly assigned in writing. We reserve the right to photograph and display completed works in our portfolio. The buyer receives the physical artwork and a non-commercial license for personal display.

8. Limitation of Liability

To the maximum extent permitted by law, our total liability for any claim related to a commission shall not exceed the amount paid for that commission. We are not liable for indirect, incidental, or consequential damages.

9. Governing Law

These Terms are governed by the laws of the Province of Nova Scotia and the federal laws of Canada applicable therein. Disputes are subject to the exclusive jurisdiction of the courts of Nova Scotia.
